Terms and Conditions

§ 1 Scope and Provider

(1) These Terms and Conditions govern all contracts between Kappasys (the "Provider") and users of the Cycling Planner platform (cycle-planner.com).

(3) These Terms apply to both consumers and business users. Conflicting terms of the user are not accepted unless explicitly agreed in writing.

§ 2 Service Description

(1) Cycling Planner is a web-based SaaS platform for planning cycling tours, including: creating and managing multi-stage tours, GPX import/export/analysis, automatic route calculation via BRouter, accommodation search via OpenStreetMap, weather forecasts via Open-Meteo, calendar export (ICS) and tour sharing.

(2) Two service tiers: Free (no charge, max. 3 tours) and Pro (paid, full feature set).

(3) Third-party services are integrated without warranty. The Provider is not liable for their outages.

§ 3 Registration and User Account

(1) Use requires registration with a valid email and password. Users must provide accurate information and keep credentials confidential.

(2) Only one account per person. Users under 16 require parental consent.

§ 4 Contract and Duration (Pro Subscription)

(1) The Pro subscription is concluded upon checkout completion (payment via Stripe). It renews monthly automatically and may be cancelled at any time before the end of the billing period.

(2) Right of withdrawal (consumers): 14 days. Expires upon commencement of digital content delivery with explicit consent.

§ 5 Prices and Payment

Current prices shown under "Plan" (EUR including taxes). Payment monthly in advance via Stripe. Price changes communicated by email at least 30 days in advance.

§ 6 User Obligations

Prohibited: automated bulk queries, circumventing security mechanisms, uploading third-party copyrighted content without permission, excessive use of infrastructure. Route recommendations are not safety guarantees; users are responsible for their own safety.

§ 7 Availability

The Provider aims for 99% annual availability without legal guarantee. Liability for outages due to force majeure or third-party failures is excluded.

§ 8 Data Protection

The Privacy Policy is available at cycle-planner.com/legal/datenschutz. Payment data is transmitted to Stripe (Stripe Payments Europe, Ltd., Dublin).

§ 9 Liability

(1) Unlimited liability for intent, gross negligence and personal injury.

(2) For slight negligence, liability is limited to foreseeable damage from breach of material obligations.

(3) No liability for accuracy of map data, route recommendations or weather forecasts.

§ 10 Intellectual Property

GPX data and tour plans remain the user's property. All rights to the platform belong to the Provider. Publicly shared tours are accessible to everyone; users are responsible for their content.

§ 11 Termination and Suspension

Users may request account deletion at any time by email. The Provider may suspend or delete accounts without notice for serious violations.

§ 12 Changes to these Terms

Changes announced by email 30 days in advance. Users may object within 30 days; silence constitutes acceptance.

§ 13 Miscellaneous

(1) German law applies (BGB), excluding CISG. Jurisdiction for business users: Provider's registered address.

(2) EU dispute resolution: ec.europa.eu/consumers/odr. The Provider does not participate in dispute resolution proceedings.
